Jins Lettings FAX-BACKLETTING INSTRUCTION FORM & GENERAL AGENCY CONDITIONS

Jins Lettings are hereby instructed to market (Property Address): on the terms & details given below on either ( ) Sole Agency Letting Fee 7,5% +VAT or ( ) Multiple Agency Letting Fee 10% +VAT. starting from (Date) Jins Lettings will select potential tenants, arrange the tenancy, collect the rent if required and it is agreed that their fees for this service shall be ( ) % of the gross rent received plus VAT.
b) When agreement has been reached in principle, we will apply for both financial & character references and review these prior to submitting them to you. c) We will collect the rent on your behalf & pay it into your account or as you direct. d) If you wish to collect the rent yourself we will deduct our fees, plus VAT, for the whole period of the tenancy or any extensions from the first month's rental.
b) For lettings of 12 weeks or less our fees will be 15% of the gross rent paid plus VAT c) If the property is sold as a result of an introduction by us it is agreed that we will receive a sales commission of ( ) % of the purchase price plus VAT & it is agreed that such commission will be paid before the distribution of the monies elsewhere. d) If the property is sold, or the title passed on, but the tenancy continues, it is agreed that the purchaser, or recipient, continues to pay our fees as originally agreed. 3. Additional Services a) For your own protection you will need a written Tenancy Agreement produced by your Solicitor or alternatively by ourselves. If you wish us to produce the Agreement for you we charge a one off fee of £50.00 plus VAT regardless of size or complexity.b) In order to record the amount & condition of the contents of the property we strongly recommend that you instruct us to appoint an Inventory Clerk to produce a Schedule for you. This service together with "checking in" the tenants are subject to a separate charge which will depend upon the size of property & the amount of contents. Should the Schedule not be produced by an Inventory Clerk then we will try our best at "check in " & "check out" but obviously we cannot guarantee the results. c) Any references we take up on your behalf on the Tenant will be free of charge. d) We will obtain from the Tenant either a suitable deposit, or Letter of Guarantee which will be used at the end of the Tenancy for such items as unpaid bills, repairs, breakage's etc. The residue of any money left will be distributed to the parties concerned after agreement of the terms. Should you wish us to negotiate these terms on your behalf we will agree a fixed fee with you depending on their complexity. e) Before the Tenants move in we will arrange for you the transfer of gas, electricity, telephone, council tax accounts etc. into their name free of charge. f) Similarly, at the end of the Tenancy, we will arrange transfer of the accounts back & this will normally be free of charge but we reserve the right to charge a suitable fee should any prolonged negotiations be involved. g) Prior to the commencement of the Tenancy we would recommend that the property is professionally cleaned so that at the end we can arrange to have it cleaned to the same standard. The initial cleaning will be to your account & the final one will be to the Tenant's account. h) Advice on what furniture & appliances to provide, gardening etc. is freely available from our Staff. i) Should you require us to provide for the management of your property, this will be reflected in our percentage fees above. Additional Fee for Full Management ( ) is 5% +VAT. We will arrange for all necessary repairs & reinstatements to be carried out on your behalf & to your account. The works shall be such that they will only be those considered reasonably necessary to maintain the property, fixtures, fittings, contents etc. in a good habitable condition. j) Whilst all reasonable steps will be taken to procure the services of competent Contractors we regret that we cannot be responsible for any loss or damage caused by them or any third party. k) We would advise you to arrange for the Post Office to forward any mail for you. l) In October 1994 the Gas Safety Regulations made Landlords responsible for the safe operation of gas appliances within their properties.We would recommend therefore that you take out a service agreement with either British Gas or a company that is Corgi registered. m) It is agreed that the terms of this agreement are ( ) Letting Only or ( ) Full Management o) Overseas Landlords should note that under S. 79 of the Taxes & Management Act 1979 we, as Agents, are responsible for deducting Income Tax. This can be cancelled by you supplying us with a letter from your Accountant or Solicitor stating that they are acting as your Tax Agent for the letting of your Property & indemnifying us against any Inland Revenue assessments raised. Alternatively, a letter issued by the Inland Revenue stating you are exempt from tax will be suitable. Unless we have such letter we are required by law to deduct tax of 25% ( or relevant basic rate tax ) until an amount has been agreed with the Inland Revenue. Supplementary Notes :
